Terms and con­di­tions of par­tic­i­pa­tion in com­pe­ti­tions

Here you will find the terms and conditions of participation for our competitions.

Holding Graz – Kommunale Dienstleistungen GmbH – hereinafter referred to as “Holding Graz” – is organising this competition in cooperation with companies owned or co-owned by Holding Graz.

  • All natural persons aged 18 or over with residence in Austria are entitled to participate. Employees of Holding Graz are not permitted to participate. Each person may only enter the competition once and in his or her own name. By participating in the competition, the present conditions of participation are accepted.
  • Participation in the competition is free of charge and voluntary and does not entail any further obligations whatsoever. The judges’ decision is final.
  • The prizes designated on the competition ticket, in print media, on the website, in the newsletter, in the blog or on the social networks will be awarded by means of a prize draw.
  • Prizes cannot be redeemed in cash; nor is there any legal entitlement to a prize. The prize cannot be transferred to other people either.
  • The winners will be notified in a timely manner about the prize assigned to them. The prize will lapse if it is not redeemed by the winner by a specified deadline which is dependent on the respective prize.
  • Any compensation obligation on the part of Holding Graz and its executive bodies and vicarious agents in connection with the competition is restricted to cases of wilful intent or gross negligence.
  • Violation of these conditions of participation as well as the provision of extraneous or false personal data will result in exclusion from the competition.
  • The use of unauthorized aids or other manipulations to gain advantages is prohibited and will also lead to exclusion from the competition.
  • The respective organizer reserves the right to subsequently exclude participants from the competition and to refuse and reclaim prizes in the event of a violation of the conditions of participation.
  • The participants can revoke the participation in the lottery at any time without giving grounds. The revocation must be made in writing, whereby it must be sent to Holding Graz by e-mail at the address [email protected] or by post.

Data privacy information Holding Graz

Processing of competition participants’ data:

The responsible party for data processing is Holding Graz – Kommunale Dienstleistungen GmbH, Andreas-Hofer-Platz 15, 8010 Graz.

The following personal data, which we receive from you in the course of your participation in the competition, will be processed: Salutation, name, date of birth (clear assignment or verification of age restriction), address, e-mail address, telephone number (if a short-term contact is necessary for e.g. winning event tickets), social media user or profile name and any personal data disclosed in the course of commenting on a post, if participation in the sweepstakes takes place via social networks.

The provision of your data is necessary for participation and for the implementation of the competition. The legal basis for the data processing is the fulfillment of the contract pursuant to Art 6 para 1 lit b DSGVO. For reporting on the competition, your data will be processed within the framework of the legitimate interest pursuant to Art 6 para 1 lit f DSGVO of Holding Graz.

These data will be first used to notify the winners by e-mail, post or telephone respectively. The address data are also used to send out the prize. In some instances, the respective cooperation partner involved who provides the prizes will take over the shipment under its own responsibility. In this case, the address data will be communicated to the respective cooperation partner for the designated purpose. The data will only be collected and processed by Holding Graz and companies associated with Holding Graz in the corporate group. The data will not be transmitted to other third-party companies.

Photographs taken in the course of the prize-giving as well as the name of the winner may be published on the website, in the newsletter, on the social media channels and in the print media of Holding Graz.

If you, as the winner, do not agree to this, we request that you notify us of your objection with the subject of the respective competition to [email protected].

For statistical purposes, we analyse in anonymous form how many participants have taken part in the respective competition. It is not possible to identify individual participants during this analysis.

In order to achieve the purposes listed above, it may be necessary in certain cases for us to disclose your data to the following recipients (service providers):

Retention periods for the data:

They will be deleted at the latest three months after the respective competition has ended and been processed.

Furthermore, reference is made to the following rights to which the data subject is entitled under the GDPR with regard to the processing of personal data:

  • Right to information on the part of the controller about the personal data concerning you according to Art 15 DSGVO.
  • Right to rectification according to Art 16 DSGVO
  • Right to erasure according to Art 17 DSGVO
  • Right to restriction of processing according to Art 18 DSGVO
  • Right to data portability according to Art 20 DSGVO
  • Right to object to processing according to Art 21 DSG-VO
